On Thursday, dozens of confidential emails involving Brett Kavanaugh were released, provoking very pointed questions on the third day of his Supreme Court confirmation hearings. Democrats pressed him to better explain his position on abortion rights, affirmative action, and his previous testimonies.

A large majority of the questions stemmed from one quote from one of the released emails, in which Kavanaugh wrote “I am not sure that all legal scholars refer to Roe as the settled law of the land at the Supreme Court level since Court can always overrule its precedent, and three current Justices on the Court would do so.”

To many, this statement appears to contradict testimony from Kavenaugh on Wednesday, when he said he considered Roe “settled as a precedent of the Supreme Court.”
